Seller Terms & Conditions

These Seller Terms & Conditions (“Seller Terms”) govern the relationship between Overpowered.gg (“Overpowered”, “Platform”, “we”, “us”) and you as a Seller, Store, or Merchant (“Seller”, “you”).
By applying for Seller status, listing products, or completing transactions on the Platform, you confirm that you have read, understood, and agreed to these Seller Terms, the General Terms of Use, the Client Terms & Refund Policy, and all referenced policies.
1. Role & Marketplace Status
- 1.1 Sellers act as independent third-party merchants.
- 1.2 Overpowered.gg:
- does not own, buy, sell, or resell Seller products;
- does not set prices or control Seller inventory;
- acts solely as a neutral marketplace intermediary.
- 1.3 Nothing in these Terms creates:
- employment;
- partnership;
- agency;
- exclusivity.
2. Eligible Products & Services
Sellers may list, subject to approval:
- Game accounts
- Game keys (PC, console, platform-specific)
- In-game currency or gold
- In-game items and skins
- Other digital gaming-related goods explicitly approved by Overpowered
Overpowered reserves the right to approve, reject, or remove listings at its sole discretion.
3. Seller Onboarding & Verification
- 3.1 Sellers must:
- be at least 18 years old;
- provide accurate and complete information;
- complete required KYC / KYB verification.
- 3.2 Overpowered may request at any time:
- identity documents;
- proof of ownership or sourcing;
- tax or business information.
- 3.3 Failure to comply may result in:
- suspension of Seller status;
- withholding of funds;
- termination of the account.
4. Product Legitimacy & Warranties
- 4.1 Sellers represent and warrant that:
- all listed products are legitimate, authentic, and lawfully obtained;
- game keys are unused, original, and region-compatible;
- accounts are fully owned and transferable at the time of sale;
- currencies, items, or skins are obtained without fraud, exploits, or unauthorized methods.
- 4.2 Sellers must not list:
- stolen, cracked, duplicated, or refunded keys;
- compromised or previously banned accounts (unless clearly disclosed);
- items obtained through exploits, chargebacks, or abuse.
5. Listing Accuracy & Disclosure
- 5.1 Sellers must provide:
- accurate descriptions;
- clear delivery timelines;
- region, platform, and restriction details;
- warranty terms, if any.
- 5.2 Misrepresentation, omission, or misleading listings constitute a breach of these Terms.
6. Delivery & Completion
- 6.1 Sellers must:
- deliver exactly what is described;
- complete delivery within the stated timeframe;
- provide proof of delivery when requested.
- 6.2 Delivery is considered complete when:
- credentials, keys, or items are delivered;
- access is granted as described;
- the Client confirms or auto-confirms delivery.
7. Warranty Obligations
- 7.1 Sellers are solely responsible for any warranty offered.
- 7.2 Unless explicitly stated otherwise:
- no lifetime or implied warranty is assumed;
- replacements or refunds are limited to the stated warranty period.
- 7.3 Account warranties do not cover:
- bans due to Client behavior;
- password sharing;
- modifications after delivery;
- game policy changes.
8. Refunds & Disputes
- 8.1 Sellers agree to Overpowered’s Refund & Dispute Policy.
- 8.2 In case of dispute:
- Sellers must cooperate fully;
- provide evidence promptly;
- accept Overpowered’s final decision.
- 8.3 Overpowered may:
- issue full or partial refunds;
- reverse transactions;
- deduct amounts from Seller balance.
9. Payments, Commission & Holds
- 9.1 Sellers are paid via Overpowered’s internal balance system.
- 9.2 Funds are released only after:
- successful delivery;
- dispute window expiration;
- internal risk checks.
- 9.3 Overpowered may:
- apply rolling reserves;
- delay payouts for risk mitigation;
- offset refunds, penalties, or chargebacks.
10. Fraud, Abuse & Penalties
- 10.1 Prohibited conduct includes:
- selling illegitimate goods;
- repeated delivery failures;
- excessive disputes;
- chargeback-linked transactions;
- attempts to bypass the Platform.
- 10.2 Penalties may include:
- forfeiture of payouts;
- negative balance adjustments;
- listing removal;
- permanent Seller ban.
11. Non-Circumvention
- 11.1 Sellers must not:
- redirect Clients off-platform;
- request external payments;
- share contact details for off-platform sales.
- 11.2 Circumvention results in:
- immediate termination;
- forfeiture of funds;
- legal action where applicable.
12. Taxes & Legal Compliance
- 12.1 Sellers are solely responsible for:
- tax reporting;
- VAT, GST, or sales taxes;
- invoicing where required by law.
- 12.2 Overpowered does not provide tax advice and is not responsible for Seller compliance.
13. Intellectual Property & Publisher Risk
- 13.1 Sellers acknowledge that:
- game IP belongs to publishers;
- resale or services may violate game rules;
- all risk related to IP or EULA violations rests with the Seller.
- 13.2 Sellers indemnify Overpowered against:
- publisher claims;
- IP disputes;
- regulatory actions.
14. Suspension & Termination
- 14.1 Overpowered may suspend or terminate Seller accounts for:
- policy violations;
- fraud risk;
- inactivity;
- platform integrity concerns.
- 14.2 Upon termination:
- pending balances may be withheld;
- disputes may still be resolved;
- access is permanently revoked.
15. Limitation of Liability
To the maximum extent permitted by law:
- Overpowered’s liability is limited to commissions earned from the Seller;
- Overpowered is not liable for Seller business losses;
- services are provided “as is”.
16. Governing Law
These Seller Terms are governed by the laws applicable to Overpowered.gg.
17. Acceptance
By listing products or completing sales on Overpowered.gg, the Seller confirms acceptance of these Seller Terms and all related policies.
