1. Introduction

Welcome to Overpowered.gg (“Overpowered”, “we”, “us”, “our”).

Overpowered.gg operates an online digital marketplace that connects gamers with independent third-party providers offering digital gaming-related services and goods, including but not limited to boosting, coaching, game accounts, game keys, in-game currency or gold, items, skins, and other virtual goods (collectively, the “Platform”).

By accessing or using the Platform, you confirm that you have read, understood, and agreed to be legally bound by these Terms of Use (“Terms”).

Non-Affiliation Disclaimer:
Overpowered.gg is not affiliated, associated, authorized, endorsed, or sponsored by any video game publisher or developer. All trademarks, game names, logos, and intellectual property belong to their respective owners and are used solely for descriptive purposes.

2. Definitions

For purposes of these Terms:

• User: Any individual accessing or using the Platform.
• Client: A User who purchases Digital Services or Digital Goods.
• Booster: An independent contractor providing boosting, coaching, duo/carry, or similar services.
• Seller: An independent User authorized to sell Digital Goods such as accounts, keys, currency, items, or skins.
• Digital Services: Gameplay-related services, including boosting, coaching, duo/carry, leveling, achievements, or challenges.
• Digital Goods: Non-physical gaming-related goods, including game accounts, game keys, in-game currency or gold, items, skins, or other virtual goods.
• Account: A registered user account on the Platform.
• Balance / Wallet: Any internal balance or credit recorded within the Platform for transaction management purposes.

3. Eligibility and Account Responsibility

You must be at least 18 years old to use the Platform.

You are solely responsible for ensuring that use of the Platform is legal in your jurisdiction.

You are responsible for maintaining the confidentiality of your Account credentials.

Each User may maintain only one Account, unless expressly authorized by Overpowered.

All activity performed through your Account is deemed authorized by you.

4. Marketplace Nature & Independent Contractors

Overpowered.gg acts solely as an intermediary marketplace.

Overpowered does not provide Digital Services or Digital Goods directly.

Boosters and Sellers act as independent contractors, not employees, agents, partners, or representatives of Overpowered.

No employment, partnership, agency, joint venture, or fiduciary relationship is created.

All transactions are entered into directly between Users. Overpowered is not a party to such transactions.

5. Scope of Services and Goods

The Platform may include, without limitation:

Digital Services

• Boosting
• Coaching
• Duo / Carry
• Leveling
• Achievement or challenge completion

Digital Goods

• Game accounts
• Game keys
• In-game currency or gold
• Items, skins, and virtual goods

Not all categories are available for all games, regions, platforms, or payment methods. Overpowered reserves the right to add, modify, restrict, or discontinue any category at any time.

6. Delivery and Completion (High-Level)

A transaction is considered delivered when the Digital Service or Digital Good has been provided as described in its listing or order details, including any applicable proof of delivery.

Once delivered, an order is considered completed, unless a dispute is opened in accordance with the applicable Refund & Dispute Policy within the required timeframe.

7. Game Rules, EULA & Risk Acknowledgment

You acknowledge that certain Digital Services and Digital Goods may violate or be restricted by a game’s rules, End-User License Agreement (EULA), or publisher policies.

You expressly accept all associated risks, including possible suspensions, bans, resets, or penalties imposed by game publishers or platform operators.

Overpowered.gg bears no responsibility for actions taken by third-party game publishers.

8. Payments, Balance & Internal Funds

Overpowered may collect payments on behalf of Boosters or Sellers.

The Platform may maintain an internal Balance or Wallet system for operational and security purposes.

Funds may be subject to clearance periods, security reviews, dispute resolution, or compliance checks.

Overpowered reserves the right to delay, withhold, or reverse payouts in cases of disputes, suspected fraud, chargebacks, or legal obligations.

9. Refunds, Disputes & Chargebacks

Refund eligibility, dispute resolution procedures, and chargeback handling are governed by the Refund & Dispute Policy and applicable role-specific terms.

The Refund & Dispute Policy is incorporated by reference and forms a binding part of these Terms.

Abusive or unjustified chargebacks may result in Account suspension or termination.

10. Role-Specific Terms

Additional terms apply depending on your role on the Platform, including but not limited to:

• Client Terms
• Booster Terms
• Seller Terms
• Refund & Dispute Policy
• Help Center Rules

These documents are incorporated by reference and become binding upon acceptance or applicability. In case of conflict, the specific role-based terms shall prevail.

11. User Conduct

Users must not:

• Engage in fraud, deception, or abuse;
• Circumvent Platform fees or payment systems;
• Contact other Users to transact outside the Platform;
• Use bots, cheats, hacks, or unauthorized automation;
• Harass, threaten, or abuse others.

Overpowered reserves the right to take enforcement action at its discretion.

12. KYC, AML & Compliance

Overpowered may require identity verification (KYC/EKYC) at any time, including submission of identification documents.

Failure to comply may result in:

• Transaction suspension
• Withholding of balances
• Account termination

Overpowered may cooperate with payment processors and authorities as required by law.

13. Intellectual Property

All Platform design, branding, software, and original content belong to Overpowered or its licensors.

Game-related intellectual property belongs to respective publishers.

Users grant Overpowered a non-exclusive, royalty-free license to use User-generated content for Platform operation and promotion.

14. Limitation of Liability

The Platform is provided “as is” and “as available.”

To the maximum extent permitted by law, Overpowered is not liable for:

• Game bans or penalties;
• Third-party actions;
• Indirect, incidental, or consequential damages.

Overpowered’s total liability shall not exceed the fees paid to Overpowered by the User in the six (6) months preceding the claim, unless otherwise required by mandatory law.

15. Indemnification

You agree to indemnify and hold harmless Overpowered, its affiliates, officers, employees, and partners from any claims, damages, losses, or legal actions arising from:

• Your use of the Platform;
• Violation of these Terms or role-specific terms;
• Violation of third-party rights, including publisher or intellectual property claims.

16. Account Suspension and Termination

Overpowered may suspend or terminate Accounts at any time for violations, suspected fraud, non-compliance, or security reasons.

Upon termination, balances may be withheld or adjusted where legally permitted.

17. Governing Law and Jurisdiction

These Terms are governed by the laws of the jurisdiction where Overpowered.gg is legally registered.
Exclusive jurisdiction lies with the courts of that jurisdiction.

18. Language and Precedence

These Terms are written in English.
In the event of any translation, the English version shall prevail.

19. Amendments

Overpowered may update these Terms at any time. Continued use of the Platform constitutes acceptance of the updated version.
